MEMPHIS, TN – Shelby County District Attorney Bill Gibbons announced Friday that a criminal court jury found a Memphis man guilty for shooting and killing a man in 2007 who was able to identify his assailant just before dying.
The jury convicted David Smith, 24, of second degree murder. Smith faces up to 25 years in prison. A judge is scheduled to sentence Smith on April 24.
According to testimony, on February 24, 2007, Smith shot and killed Horace Brewer, Jr. outside a laundromat on Park. Brewer identified his killer and provided police with a description of his vehicle shortly before he died from the gun shot wounds. The medical examiner said Brewer had been shot seven times.
Smith had been indicted for first degree murder, which is covered by the D.A.’s “No Deals” policy on violent crimes. Exceptions to the policy are made for legal or ethical reasons.
Assistant District Attorneys Alanda Dwyer and Dean DeCandia prosecuted this case.
