District Attorney Announces Decision in Bartlett Police Shooting

MEMPHIS, TN – Shelby County District Attorney Bill Gibbons announced Friday that, after reviewing all of the evidence from the completed homicide investigation by the Memphis Police Department, there is insufficient proof to file criminal charges against the Bartlett police officer who shot and killed a Memphis man in March.  District Attorney Gibbons added, however, that the matter will remain open pending a review by the Federal Bureau of Investigation (FBI).

           

Last month, the District Attorney’s office made a decision based on preliminary information that charges would not be filed at that time.  It is standard procedure to make a final decision on criminal charges in an officer-involved shooting after the entire investigation is completed. A typical homicide investigation can take weeks to complete.

 

On March 11, 2010, Bartlett Police Officer Patrick Cici shot and killed Malcolm Shaw while executing a search warrant at Shaw’s home in Memphis.

 

 

The District Attorney’s office received the final investigative report from Memphis Police Department homicide detectives.  Based on the information in the final report, both the district attorney and the assistant district attorney who heads the D.A.’s grand jury section found insufficient evidence to approve criminal charges against Cici.
