On Saturday, May, 28, 2011, Anthony Dewayne Hervey was involved in an argument with a male victim at the victim's house in the 4000 block of Maumee. After the argument, Hervey armed himself with a handgun and confronted the man and shot him. The victim sustained critical injuries and was hospitalized.
Criminal attempt second degree murder is a class "B" felony with a sentence range between eight (8) to thirty (30) years. Employment of a firearm during the commission of a dangerous felony is a class "C" felony with a mandatory minimum six (6) year sentence. Hervey will be sentenced on January 31st, 2013.
Assistant District Attorney Meghan Fowler prosecuted the case.
