MEMPHIS - Aug. 21, 2014 - A security guard at McDonald’s was convicted of assaulting a customer who had refused to leave the restaurant, said Shelby County Dist. Atty. Amy Weirich.
A Criminal Court jury convicted defendant Antonio Kerr, 33, of the misdemeanor offense after the customer testified that Kerr attacked him on Jan. 20, 2013, at the McDonald’s at 1861 S. Third in southwest Memphis.
The customer said he was eating lunch when Kerr told him to take his foot off of another seat at his table. The customer said he complied with Kerr’s order, but objected when the guard ordered him to leave the restaurant.
The customer said Kerr refused his request to speak to the manager and that when he did not leave the restaurant the guard grabbed him and banged his head on the table several times.
A video of the incident was shown to the jury.
Kerr faces up to 11 months and 29 days in jail when he is sentenced on Sept. 9 by Judge W. Mark Ward.
The case was handled by assistant district attorney Greg Gilbert, Lead Prosecutor in Criminal Court Division 9.
